* Notice for those Involved in Traffic Accidents
Date : 103/11/01
1、For a traffic accident resulting in bodily injury, disability or death, except in cases where the car is being deliberately conducted by the car driver or victim in the commission of a crime (which includes drunk driving), the victim or his/her successor may apply for insurance benefits or claim compensation by law, for which the procedure is easy and simple and there is no need to entrust or pay others to do it. For more details, please consult the headquarters or branches of respective insurance companies, or the Motor Vehicle Accident Compensation Fund (TEL. No. 08000565678). To receive quicker and better services, the insured or victim or his/her successor shall notify the insurance company of the information on the parties involved in the accident, the time when the accident occurred, and a full written description within five days after the occurrence of the accident.2、The involved parties or interested parties may come to the Police Precinct to enquire about the accident handling progress during the office hour seven days after completing the on-site handling of the accident. At the same time, the involved parties or interested parties may apply for review or issuance of the traffic accident scene sketches and photos; or apply for the “Traffic Accident Preliminary Analysis Report” 30 days after the occurrence of the traffic accident. Applications are subject to fees.3、For vehicle damage or property loss cases, the involved parties may negotiate for compensation on their own, directly resort to the mediation committee of the (township, district or city) office, or file a civil lawsuit in the district court for a verdict. (The police authorities will not respond or interfere with civil compensation cases.)4、For liability in criminal injury cases, the victim, within six months after the occurrence of the traffic accident, may take the initiative to file a petition (with the supplementary civil action case) with the Criminal Investigation Brigade of the Police Precinct or with the District Prosecutors Office having the jurisdiction over the case. As for civil compensation, the involved parties may negotiate for compensation on their own, directly resort to the mediation committee of the (township, district or city) office, or file a civil lawsuit in the district court for a verdict.5、The involved party, within six months after the occurrence of the traffic accident, may apply to the local Committee for the Appraisal of Vehicle Driving Accidents for an appraisal of the traffic accident. 6、In the case that the involved are foreign passport holders, please contact the Foreign Affairs Section of the Police Department. For a traffic accident caused by a military vehicle, the case shall be processed by the military police brigade having the jurisdiction over it.
